Europees Recht is vandaag de dag een vast onderdeel van de rechtspraktijk. Bijna iedere zaak kent een Europees randje, of het nu over vastgoed, migratie of procesrecht gaat.
Het recht van de Europese Unie ('Unierecht') is voor alle overheden en ondernemingen van belang. Steeds vaker heeft het niet-naleven van Europese regelgeving belangrijke financiële en politiek-bestuurlijke consequenties. Bijvoorbeeld: een subsidie moet worden terugbetaald, een overeenkomst is nietig, of een ministriële regeling kan niet worden gehandhaafd. Met als gevolg dat alle gemaakte afspraken binnen een project moeten worden teruggedraaid.
Pels Rijcken heeft de specialisten in huis die het overzicht hebben over dit snel groeiende terrein. Wij hebben ruime ervaring met procedures bij de Europese Commissie en het Hof van Justitie van de Europese Unie. Dit onderscheidt ons van sectorspecialisten die zich beperken tot deelterreinen van het Unierecht. Onze specialisten zijn bij uitstek in staat praktijkgericht te adviseren over de toepassing van regelgeving op een concrete zaak en een weloverwogen risico-inschatting te maken.
Wij treden regelmatig op bij de bestuursrechter en de burgerlijke rechter in procedures met Europeesrechtelijke geschilpunten. Dat varieert van vervoersconcessies tot voedselveiligheid. Pels Rijcken heeft een indrukwekkend track record van zaken waarin de rechter wetgeving of besluiten toetst aan de Europese verdragsregels, zoals het vrij verkeer van diensten of het vrij kapitaalverkeer.
In de adviespraktijk zijn mededinging, staatssteun en interne markt de zwaartepunten. Onze mededingingspraktijk omvat ook de Wet markt en overheid. De staatssteunpraktijk maakt een sterke groei door. Ons staatssteunteam adviseert onder meer over subsidieverlening, (revolverende) fondsen, gebiedsontwikkeling, overheidsdeelnemingen of steun voor duurzame en innovatieve projecten. Een terugkerend thema is hoe publieke belangen binnen de staatssteunkaders een plaats kunnen krijgen.
Onze aanpak is steeds gericht op het aandragen van concrete oplossingen. Graag brengen we met u in kaart waar precies behoefte aan bestaat. Soms is een quickscan of een PowerPoint genoeg. Andere zaken vragen om een diepgaand advies, bijvoorbeeld als nieuwe rechtsvragen aan de orde zijn. Als veel partijen betrokken zijn, kan een handreiking of een helpdesk uitkomst bieden. In alle gevallen staat de samenwerking met u voorop.
